A listing agreement for real estate agents in South Carolina defines the terms of the relationship between a real estate agent and an individual who is trying to sell a residential property (client or client). The broker undertakes to exercise his marketing expertise in the attempt to sell the client`s property at a fair price and in return they receive a percentage of the final price (commission). The terms of the agreement are negotiable and it is important for the customer to understand what should be included in the agreement and what is not. While contracts may vary, the following should be included; Bonds and obligations of the broker and owner, commission rate, real estate information, disclosure and duration of the agreement. Real Estate Disclosure Statement (No. 27-50-40) – Before a real estate transaction can be completed, the seller of the property must provide a disclosure form to the buyer. List of exclusive agencies: a contractual agreement under which the stockbroker acts as a legally recognized non-agency broker or agent of the seller and the seller (s) agrees to pay a commission to the stockbroker if the property is sold by the efforts of a real estate agent. If the property is sold exclusively by the efforts of the seller or sellers, the seller is not required to pay a commission to the stockbroker. (Modified 5/06) Exclusive right to sale: a contractual agreement under which the stockbroker acts as an agent or as a legally recognized non-agency representative of the seller (s) and the seller (s) agrees (s) to pay a commission to the listing broker, whether the property is sold by the efforts of the stockbroker, seller or another person; and a contractual agreement under which the stockbroker acts as an intermediary or as a non-agent representative of the legally recognized seller (s), and the seller (s) engages, to pay a commission to the broker, whether the property is sold by the efforts of the broker, seller or anyone else, except that the seller may designate one or more individuals or legal entities as exceptions in the listing agreement and that if the property is sold to an exempt individual or corporation, the seller is not required to pay a commission to the stock exchange. (Modified 5/06) Agency Disclosure Form (No. 40-57-370) – Realtors must inform potential clients of the nature of brokerage relationships by providing a disclosure form to agencies upon first contact with the client.
